I. GENERAL RULES

  1. Trail Running Factory – is voluntary series of camps, organized by Organizer in different places around the world throughout the year.
  2. Organizer – Trail Running Factory, UAB, address Anykščių g. 33-50, LT-20178 Ukmergė, company code 304948856, represented by the director Gintarė Burokaitė-Griniuvienė.
  3. Participant – person aged 18 years or older who undertakes voluntary and consciously participation in the camp and accept Rules.
  4. Partner – subject co-operating with organizer in order to organize the camp.
  5. Rules – regulations and arrangements provided by Organizer and applied during the camp, regulating terms and conditions of participation and organization of the whole camp, integral part of the agreement with the participant.
  6. Agreement – contract of mutual obligations made between Organizer and Participant.

II. CONDITIONS OF PARTICIPATION

  1. Participation in the camp is voluntary.
  2. Each Participant takes part in the camp at his own risk.
  3. Each Participant needs to be 18 years old or older and have valid visa/passport for at least 6 months period from the end of the camp.
  4. Custom and exchange control regulations of Lithuania, destination country and transit countries apply to Participants. 5. Every Participant acknowledges, that transportation to the camp place needs to be organized and funded on his own. 6. Each Participant declare to the best of his knowledge that his health condition allows him to participate in the camp and does not require insurance or any other special policy.
  5. Each Participant acknowledges and accepts that participation in the camp activities involves above average physical activity and carries certain risks, such as personal injury, death and loss of or damage to his property. Each participant considered and assessed possible risks, which are involved in camp participation, takes part in it voluntary and on his own responsibility.
  6. Each Participant acknowledges and accepts the risks which may arise during any means of transportation of Partici- pant from / to the pick up place / airport / hotel etc., as well to / from starting and finishing points or places of daily activi- ties planned in camp schedule. These risks include, but are not limited to, all liability asssociated with the operation of vehicles, any and all injuries or death of the driver and / or passengers and any and all property damages accociated with transportation. Each Participant gives permission to be driven / transported by the driver assigned / hired by Organiser. Participant exempts Organizer from any liability asociated with transportation risks.
  7. Each Participant gives permission to receive emergency medical or surgical treatment and hospitalization if neces- sary. Participant authorizes medical and paramedical staff to act on his behalf according to their best judgment in any emergency requiring medical or surgical treatment and hospitalization if necessary. Moreover Participant agrees to cover all costs of such medical or surgical treatments, at the same time exempting Organizer from the obligation to provide service to subjects, which are providing this help.
  8. Each Participant declares, that in the future he will not claim a right to redress from the Organizer in case health detriment or material loss connected with the participation in the camp.
  9. Each Participant understands and agrees to comply with all of the rules established by Organizer, and also follow absolutely his directions and directions of people working on behalf of Organizer.
  10. Each Participant declares, that he/she has valid active leisure (running, trail-running, hiking, trekking) insurance. III. PAYMENTS

  1. Participant commits to pay for the camp according to the payment schedule indicated by Organizer. Payment will be made in the following way, down payment made at the time of registration and it is not refundable. Final payment of the balance made no later than 40 days prior to the camp start date.
  2. Medical, travel or other insurance is not included in the camp price, but strongly recommended to acquire prior the camp.
  3. Organizer reserves the right to change the price of the camp for unpredictable reasons at the time of price fixing, ie changes in exchange rates, increase of customs, taxes or charges affecting the price of the camp etc., not later than 10 days before the start of the camp.

IV. OTHER RIGHTS AND OBLIGATIONS

  1. From the beginning of the camp, the Participant is obliged to adhere to the Organizer’s instructions and instructions of Organizer employees, concerning the realization of the program and the realization of the offer.
  2. In case of serious breach by the Participant of a determined order of the camp, threatening the interests of other Participants, the Organizer may terminate the contract immediately. All expenses for further stay abroad and return to the country must be covered in such case by the Participant of the camp.
  3. The participant shall not be entitled to reimbursement of benefits which he has not used for the duration of the camp for reasons attributable to the Participant.
  4. Resignation of a participant from the camp requires a written statement sent by e-mail to gintare@trailrunningfactory.com
  5. Organizer informs about the possibility of additionial insurance, which could be purchased to cover the costs in case of canceled event. In case of resignation, all costs of the organizer of the camp will be deducted from the resigning Participant. If you cancel your participation within less than 40 days before the camp, you are not entitled to any refund of your deposit. Refund of payment will be done by the Organizer within 30 days after the end of the camp.
  6. If, due to the fault of the Organizer or his Partner, certain benefits or the quality of these benefits are blatantly depart- ed from the quality, which result from the contract, the Organizer assumes the appropriate financial responsibility and reimburses part of the fee charged for the service, according to discretionaly judment in such case.
  7. All complaints should be immediately send on e-mail address of the Organizer, but no later than 30 days after the end of the camp, later no complaints will be accepted. The complaint will be considered by the Organizer within 30 days from the day of its submission.

V. DISCLAIMER

  1. Organizer is not responsible for the actions and decisions of the third party which may cause disturbancies or cancel- ation of th camp.
  2. Organizer is not responsible for the risks, injuries or death which may occur during any transportation of Participant during the camp or by utilization of his / her any means of transportation during the camp. These risks include, but are not limited to, all liability asssociated with the operation of vehicle, any and all injuries or death of the driver and / or passengers and any and all property damage accociated with transportation.
  3. Organizer is not responsible for the actions and decisions of the state administration and consular offices, and in particular for refusing to issue a passport or a visa on time, which will make it impossible to participate in the camp activities.
  4. Organizer will not be responsible for damage and loss, which arise for reasons beyond his control i.e. weather condi- tions, decisions of the authorities of the state, strikes, force majeure etc.
  5. Organizer will not be responsible for items left or stolen in the Participants place of residence.
  6. Organizer reserves the right to cancel a camp for reasons of insufficient number of Participants prior 40 days before the beginning of the camp and in any other time for reasons beyond his control. In this case, Organizer commits to present alternative offer to Participants and include down payment for the alternative camp. Down payment is not refundable.

VI. FINAL PROVISIONS

  1. These terms and conditions are integral part of Agreement.
  2. To all matters not settled in these terms and conditions and Agreement provisions of Civil Code shall apply.
  3. Disputes that may arise because of this agreement are governed by Lithuanian law and resolved by the court having jurisdiction over a company’s seat.
